Terms of Service

1. Agreement and eligibility
These Terms govern your use of Ugly Baby Tracker, operated by the provider identified on your checkout receipt (“we”, “us” or “our”). By creating an account or using the service, you agree to these Terms. You must be at least 18 years old and able to enter a binding agreement. If you add information about a child or invite another carer to use your account, you confirm that you have authority to do so.
2. What the service does
Ugly Baby Tracker is a general household record-keeping tool for adult parents and carers. Its baby-tracking categories are limited to poops, pees, feeds, pumping, sleep start and wake times, weight, height, and food or allergen introductions. The service also holds the child profile, household access details, preferences and technical record information needed to operate those features.
Records are entered by authorised users. The service may organise those entries into histories, counts, elapsed-time and sleep-duration summaries, exports, and WHO reference centile charts. It does not obtain clinical records from healthcare providers, connect to medical monitoring equipment, or continuously monitor a child. Features may change as the service improves. We aim to keep the service available and accurate, but do not promise uninterrupted operation or that every calculation or chart will be error-free.
3. Not a medical application
Ugly Baby Tracker is designed and supplied only for general household record keeping. It is not intended for clinical practice or for use as a medical device, medical record, diagnostic or screening tool, treatment tool, emergency service, or substitute for advice from a qualified health professional.
The service does not diagnose, screen for, prevent, clinically monitor, predict, make a prognosis about, alleviate or treat any disease, condition, ailment or defect. It does not recommend treatment or generate recommended or predictive feeding, pumping, hydration or sleep schedules.
The service does not determine whether a child is adequately fed or hydrated, whether a measurement or routine is normal or safe, or whether medical attention is required. It does not provide alerts for dehydration, inadequate feeding, abnormal growth, unsafe sleep, an allergic reaction, illness or any other health or safety risk.
Summaries, elapsed times, sleep durations, percentiles and WHO centile charts are automatically generated reference presentations based on information entered by users. They are not clinical assessments and may be affected by incomplete, delayed or inaccurate entries or measurements.

4. Accounts and household access
You are responsible for keeping your password and devices secure, for information entered through your account, and for promptly telling us about suspected unauthorised access. Do not share an account outside your household or use another person’s account without permission. You remain responsible for deciding who may see information about a child.
5. Access, billing and cancellation
Access to the live tracker requires an active or trialling monthly or annual subscription, or a completed Lifetime Supporter purchase. Price, currency, billing interval, taxes, renewal terms and any trial are shown before purchase. For Lifetime Supporter access, Stripe lets you choose a one-time amount at or above the minimum shown on the Pricing page; the amount you confirm at Checkout is charged once and does not renew.
Stripe hosts checkout and processes card details; we receive the customer, subscription or payment identifiers and status needed to provide access. For a recurring plan, you authorise charges until cancellation. You can cancel through the Account or Billing page; cancellation prevents renewal and access continues until the end of the current paid period. Lifetime Supporter access has no recurring plan to cancel and means access for the operating life of the service, not a promise that the service will exist for any particular number of years. Deleting your account permanently gives up that access. Except where law requires otherwise, fees already charged are not refundable merely because you stop using the service or delete your account.
6. Acceptable use
You must not misuse the service, break the law, probe or bypass security, interfere with other users, upload malicious material, scrape private areas, overload the service, reverse engineer protected components, or use the service to harm or monitor another person without authority. We may limit or suspend access where reasonably necessary to protect users, the service or the law.
7. Your information and backups
You retain responsibility for the information you enter. You give us permission to host, process, back up and display that information only as needed to operate and secure the service, provide the features you request, and meet legal obligations. We do not sell, rent or trade personal information, use it for advertising, or share it with advertisers, data brokers, social networks or analytics providers. Limited processing by the infrastructure, billing and email providers described below is explained in the Privacy Policy. Keep independent copies of any information you cannot afford to lose.
8. Intellectual property
We and our licensors retain rights in the service, software, design, branding and supplied content. These Terms give you a personal, limited, non-exclusive, non-transferable right to use the service while your account is entitled to access. They do not transfer ownership of the service to you.
9. Third-party services
Our intended production configuration uses a DigitalOcean Droplet in Sydney, Australia to host the application, database and private tracker records. Cloudflare provides a global content delivery and security service for the public landing page only; signed-in tracker pages are served directly from the Australian application host. Cloudflare may process public-page request and security metadata, but is not used to serve or cache baby-tracking records.
Stripe receives the account email, internal billing reference, payment information entered at Stripe, and customer, subscription, payment and fraud-prevention information needed for checkout and billing. Resend receives the recipient email address, transactional message and verification or invitation link, and returns delivery status. Stripe and Resend do not receive baby-tracking records from us.
These providers act under their own terms and privacy policies. A provider outage may temporarily affect hosting, public-page delivery, checkout, email or other features.
10. Consumer rights and liability
Nothing in these Terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law. To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss caused by unauthorised account use, or decisions made from unverified tracker data. Where a remedy may lawfully be limited, our liability is limited to resupplying the service or paying the reasonable cost of resupply.
11. Suspension, termination and changes
You may stop using the service at any time. We may suspend or end access for material breach, non-payment, security risk, unlawful use, or if the service closes, using reasonable notice where practicable. We may update these Terms for legal, security or service changes. Material changes will be notified through the service or your account email and apply prospectively from the stated date.
12. Governing law and contact
These Terms are governed by the laws of New South Wales, Australia, and the courts with jurisdiction there, without limiting any rights you have under applicable consumer law. Signed-in users can contact us through Support. If you cannot sign in, use the operator contact details shown on your Stripe receipt.
